Terms of Service
Welcome to DMARCwise, a DMARC monitoring and reporting service (the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Service.
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.
Eligibility and intended use
You must be at least 18 years old to use the Service.
The Service is offered under two different usage models:
- The free plan may be used by individuals, including consumers, as well as organizations.
- Paid subscription plans are intended exclusively for professional and business use. By subscribing to a paid plan, you confirm that you are acting in a business or professional capacity and not as a consumer for purposes of applicable consumer protection laws.
User obligations and responsibilities
You are responsible for providing accurate and complete information when creating an account and for keeping that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect unauthorized access or a security breach, you must notify us promptly.
You agree to use the Service in compliance with these Terms and all applicable laws and regulations.
License to use the service
Subject to these Terms and any applicable subscription, DMARCwise grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your internal purposes during the term of your account.
No rights are granted to you other than those expressly stated in these Terms.
Acceptable use
You may not use the Service in a way that interferes with its normal operation, security, or availability, or that attempts to access systems or data not intended for you.
You may not copy, modify, reverse engineer, resell, sublicense, or otherwise make the Service available to third parties, except where explicitly permitted by your subscription plan or agreed in writing.
You must not use the Service to engage in unlawful, harmful, or prohibited activities, including:
- attempting to gain unauthorized access to the Service or related systems;
- interfering with or disrupting the Service (including by abuse, excessive automated requests, or attacks);
- using the Service to violate the rights of others (including privacy and intellectual property rights);
- using the Service to send, host, or process illegal content.
Subscription and payment terms
- DMARCwise offers subscription-based access to its services. Subscription fees are billed in advance on a recurring basis, depending on the plan you choose.
- You agree to pay all fees associated with your subscription. You are responsible for all applicable taxes unless explicitly stated otherwise.
- You may cancel your subscription at any time from the dashboard. Cancellation stops future billing but does not provide a refund for the current billing period.
- All fees are non-refundable, except as required by law or as explicitly stated in these Terms.
- In the event of a billing error, you must contact DMARCwise support within 30 days of the date of the error. If we determine, at our sole discretion, that a billing error occurred, we will issue a refund or credit to your account as appropriate.
- Refunds will not be issued for any partial billing periods or for any unused portion of a subscription.
- Payments are processed by Paddle, a Merchant of Record (MOR) which acts as a reseller for DMARCwise. Invoices and payment records are issued by Paddle in accordance with its terms and conditions presented during checkout.
- We reserve the right to change pricing or plan features with reasonable notice. Changes will take effect at the start of the next billing period unless otherwise required by law.
Free plan
- DMARCwise offers a free plan with limited features and usage.
- The free plan is provided on an “as is” basis and may include feature or usage limitations.
- We reserve the right to modify, restrict, or discontinue free plans at any time to prevent abuse or for operational reasons.
Free trial
- Free trials, where offered, provide temporary access to paid features for a limited time. At the end of the trial period, continued use of paid features requires an active paid subscription.
- You may cancel your free trial at any time before it ends without any charge.
- We reserve the right to modify, restrict, or discontinue free trials at any time to prevent abuse or for operational reasons.
Usage limits and overages
- Some plans include usage limits based on the volume of DMARC aggregate report data processed (for example, the number of messages reported in aggregate reports).
- Usage limits apply only to plans where such limits are explicitly stated. For plans that do not specify a usage limit, the processing of reports such as DMARC reports is deemed unlimited, subject to legitimate use as determined by DMARCwise.
- We reserve the right to introduce or enforce usage limits if excessive usage negatively impacts the Service, security, or other customers. Where reasonably possible, we will notify you and provide an opportunity to upgrade before restricting or terminating the service.
Personal data handling
- Our handling of personal data in connection with the service is described in our Privacy and GDPR documentation.
- You are responsible for ensuring that your use of the Service complies with applicable data protection and privacy laws.
Data ownership and customer content
- Anything you upload to the Service, configure in it, or cause the Service to receive and process (including DMARC aggregate reports and configuration data) is your content (“Customer Content”).
- Between you and DMARCwise, you keep all rights to Customer Content.
- You give DMARCwise permission to use Customer Content only as needed to provide, operate, maintain, secure, and improve the Service, and to support you.
- DMARCwise does not claim ownership of Customer Content and does not use it for purposes unrelated to the provision of the service.
Security
- We implement and maintain reasonable administrative, technical, and organisational measures designed to protect the Service and Customer Content against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or unauthorised access.
- Security measures may include access controls, encryption in transit, monitoring, and procedures for managing vulnerabilities and incidents. Specific measures may change over time as we improve the Service.
- While we take security seriously, no method of transmission or storage is completely secure, and we do not guarantee that Customer Content will be free from all security risks.
Confidentiality
- During the use of the Service, you and DMARCwise may share non-public information with each other, such as business, technical, or commercial information (“Confidential Information”).
- Each party agrees to keep the other party’s Confidential Information confidential and to use it only to perform under these Terms.
- Confidential Information does not include information that the receiving party can show:
- is or becomes public through no fault of the receiving party;
- was already lawfully known to the receiving party before it was disclosed;
- is independently developed without using the Confidential Information; or
- must be disclosed by law, regulation, or a valid order from a court or authority (in which case the receiving party will give notice when legally allowed).
- Each party will take reasonable steps to protect Confidential Information from unauthorized access or disclosure.
Intellectual property rights
- DMARCwise and its associated trademarks, logos, and service marks are owned by us or our licensors. The Service (including its software, design, and documentation) is protected by applicable intellectual property laws.
- You may not copy, modify, distribute, sell, lease, or reverse engineer the Service (except to the extent such restriction is prohibited by law).
Service availability and maintenance
- We strive to maintain high availability of our service, but we do not guarantee uninterrupted access.
- The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our reasonable control.
Third-party services
- The Service may integrate with or rely on third-party services (for example, payment processing through Paddle). Third-party services are provided under their own terms and policies. We are not responsible for third-party services that are not under our control.
Disclaimer of warranties
- The Service is provided on an “as is” and “as available” basis.
- DMARCwise makes no warranties that the Service will be uninterrupted, error-free, or fully accurate.
- DMARC data and reports depend on third-party email receivers, DNS configuration, and industry standards that are outside our control. We do not guarantee email deliverability, policy enforcement, or that all authentication issues will be identified.
Limitation of liability
- To the maximum extent permitted by law, DMARCwise shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or business opportunities.
- DMARCwise’s total liability arising out of or relating to the Service or these Terms shall not exceed the total fees paid by you for the Service during the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless DMARCwise from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your lack of authority over the domains or data you process using the Service.
Force majeure
DMARCwise shall not be liable for delays or failures in performance resulting from events beyond its reasonable control, including natural disasters, internet or infrastructure failures, acts of government, war, terrorism, labor disputes, or failures of third-party service providers.
Termination of service
- We may suspend or terminate your access to the Service if you violate these Terms, misuse the service, or if continued access poses a security, legal, or operational risk to DMARCwise or other customers. Where reasonably possible, we will provide notice prior to suspension or termination.
- You may delete your account through the account settings in the dashboard. Upon deletion, your access will end and your data will be permanently erased and cannot be recovered. Residual copies may persist in backups for a limited period and will be deleted in accordance with our retention practices.
- Provisions that by their nature should survive termination will survive, including, for example, intellectual property, limitation of liability, and governing law.
Assignment
You may not assign these Terms without prior written consent. DMARCwise may assign these Terms as part of a merger, acquisition, or sale of assets.
Changes to these terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Italy, and any disputes arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts in Italy.
