Introduction

Welcome to DMARCwise, a DMARC monitoring and reporting service. By using our service, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

User Obligations and Responsibilities

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to use the service in compliance with all applicable laws and regulations.
  • You must not use the service to engage in any unlawful or prohibited activities.

Subscription and Payment Terms

  • DMARCwise offers subscription-based access to its services.
  • Subscription fees are billed in advance on a recurring basis, depending on the plan you choose.
  • You agree to pay all fees associated with your subscription.
  • You may cancel your subscription at any time by contacting our support team. Cancellation will stop future billing but will not provide a refund for the current billing period.
  • All fees are non-refundable, except as required by law or as explicitly stated in these Terms.
  • In the event of a billing error, you must contact DMARCwise support within 30 days of the date of the error. If we determine, at our sole discretion, that a billing error occurred, we will issue a refund or credit to your account as appropriate.
  • Refunds will not be issued for any partial billing periods or for any unused portion of a subscription.
  • Payments are processed by Paddle, a Merchant of Record (MOR) which acts as a reseller for DMARCwise. You will receive an invoice for your payments directly from Paddle. For more information, please visit Paddle Checkout Buyer Terms and Conditions.

Free Plan

  • DMARCwise offers a free plan with limited features and usage (“Free Plan”).
  • The Free Plan is provided on an “as is” basis, and DMARCwise reserves the right to modify or discontinue it at any time without prior notice.
  • DMARCwise reserves the right to convert Free Plan accounts to paid subscriptions or terminate Free Plan accounts at its discretion, especially in cases of abuse or excessive usage.
  • Support for Free Plan users may be limited compared to paid subscribers.

Free Trial

  • DMARCwise offers a 14-day free trial (“Free Trial”) for new users to experience the full features of our paid plans.
  • To start a Free Trial, you are not required to provide payment information upfront.
  • The Free Trial provides access to most or all features of our paid plans for 14 days.
  • At the end of the Free Trial period, you will be prompted to choose a paid plan and enter valid payment information to continue using the service.
  • You may cancel your Free Trial at any time before it ends without any charge.
  • DMARCwise reserves the right to modify the duration or terms of the Free Trial offer at any time.
  • Free Trial eligibility is determined at DMARCwise’s sole discretion, and we may limit eligibility or duration to prevent abuse.
  • Only one Free Trial is permitted per user or organization. Attempting to create multiple accounts to access additional Free Trials is prohibited.

Usage Limits and Overages

  • While current plans do not have a hard limit on the number of emails processed, DMARCwise reserves the right to implement such limits in the future.
  • If your usage significantly exceeds what we deem to be reasonable for your current plan, we may require you to upgrade to a higher-tier plan that better suits your needs.
  • In cases of excessive usage, DMARCwise will attempt to notify you and provide an opportunity to upgrade your plan.
  • If you do not upgrade your plan after being notified of excessive usage, DMARCwise reserves the right to:
    • Limit or throttle your service usage
    • Automatically upgrade you to an appropriate plan that matches your usage
    • Suspend your service until the issue is resolved
  • DMARCwise will make reasonable efforts to contact you before taking any of these actions, but we reserve the right to take immediate action in cases where excessive usage is impacting our ability to provide service to other customers.
  • Any disputes regarding usage or resulting actions must be raised with our support team within 30 days of the incident.

Data Handling and Privacy

  • Our collection and use of personal information in connection with the service is described in our Privacy Policy.

Intellectual Property Rights

  • DMARCwise and its associated trademarks, logos, and service marks are owned by us.
  • You may not use our intellectual property without our prior written consent.

Service Availability and Maintenance

  • We strive to maintain high availability of our service, but we do not guarantee uninterrupted access.
  • We reserve the right to perform maintenance on our systems, which may result in temporary service interruptions.
  • We will make reasonable efforts to notify you in advance of any scheduled maintenance.

Limitation of Liability

  • To the fullest extent permitted by law, DMARCwise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
  • DMARCwise provides the service on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the service’s reliability, availability, or fitness for a particular purpose.

Termination of Service

  • We reserve the right to suspend or terminate your access to the service if you violate these Terms or for any other reason at our discretion.
  • To delete your account, you must submit a request to our support team. Once processed, all associated data will be permanently removed from our systems. This action is irreversible.
  • Upon account deletion, you will permanently lose access to the service. All of your data will be permanently erased and cannot be recovered.

Modifications to the Terms of Service

  • We reserve the right to modify these Terms at any time.
  • We will notify you of any material changes to these Terms via email or through our service.
  • Your continued use of the service after such notification constitutes acceptance of the modified Terms.

Governing Law and Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of Italy.
  • Any disputes arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts in Italy.
